1. Acceptance of Terms

By accessing and using Aestoria's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use our services.

These terms apply to all visitors, users, and others who access or use our services. We reserve the right to update these terms at any time, and your continued use of our services constitutes acceptance of those changes.

2. Description of Services

Aestoria provides creative design services including but not limited to branding, web design, UI/UX design, packaging design, and visual identity development. Our services are provided on a project basis and are subject to the specific terms outlined in individual project agreements.

Our services include:

  • Brand strategy and identity design
  • Website design and development
  • User interface and user experience design
  • Packaging and print design
  • Marketing and promotional materials

3. User Accounts

To access certain features of our services, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, false, or incomplete.

4. Intellectual Property Rights

All content, features, and functionality of our services, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, are the exclusive property of Aestoria and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Upon full payment for services rendered, clients receive the agreed-upon usage rights to the final deliverables as outlined in the project agreement. Unless otherwise specified, Aestoria retains the right to showcase completed work in our portfolio and marketing materials.

5. User Content

You retain all rights to any content you submit, post, or display on or through our services. By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content for the purpose of providing our services.

You represent and warrant that you own or have the necessary rights to all content you submit and that such content does not violate any third-party rights or applicable laws.

6. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

 

  • Using our services for any illegal purpose or in violation of any laws
  • Attempting to gain unauthorized access to our systems or networks
  • Interfering with or disrupting the integrity or performance of our services
  • Copying, modifying, or distributing our content without permission
  • Using automated systems to access our services without authorization
  • Harassing, threatening, or defaming others through our services

 

7. Payment and Billing

Payment terms are outlined in individual project agreements. Unless otherwise specified, a deposit of 50% is required before work commences, with the remaining balance due upon project completion. All payments must be made within 14 days of invoice date.

Late payments may incur interest charges of 1.5% per month or the maximum rate permitted by law, whichever is lower. We reserve the right to suspend services for accounts with overdue payments.

8. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use our services will immediately cease.

Either party may terminate a project agreement with written notice. If you terminate a project before completion, you are responsible for payment of work completed up to the termination date, plus any applicable cancellation fees as outlined in the project agreement.

9. Disclaimers

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that our services will be uninterrupted, timely, secure, or error-free.

While we strive to deliver the highest quality work, we make no guarantees regarding the business results or outcomes achieved through use of our services. Success depends on numerous factors beyond our control.
